Terms and Conditions of Sale
Article 1: Object
These general terms and conditions of sale (hereinafter referred to as « GTCS ») apply without restriction or reservation to all sales concluded by AFROVENGERS SAS (hereinafter referred to as « the Company ») with non-professional buyers (hereinafter referred to as « the Customers » or « the Customer »), wishing to acquire the products offered for sale by the Company (hereinafter referred to as « the Products ») on the website www.afrovengers.com. They specify the conditions of order, payment, delivery, and management of any returns of Products ordered by Customers.
Article 2: Acceptance of the GTCS
The acquisition of a Product through the site implies unreserved acceptance by the Customer of these GTCS, which the Customer acknowledges having read before ordering. The Customer declares to have the legal capacity to contract under French law or to validly represent the person for whom he/she undertakes.
Article 3: Products
The Products offered for sale on the website are as follows: clothes and accessories. The main characteristics of the Products and in particular the specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the site. The Customer is required to read it before placing an order. The choice and purchase of a Product are the sole responsibility of the Customer. Product photographs are not contractual and cannot engage the responsibility of the Company. The Customer must refer to the description of each Product to know its properties and essential features.
Article 4: Orders
Orders are placed directly on the website or others platforms we have as shopify. The Customer can select as many Products as he/she wishes, which will be added to the basket. The Customer must verify the accuracy of the order and report or correct any errors immediately. The order will only be considered final after sending the Customer confirmation of acceptance of the order by the Company by email and after receipt by the latter of the full price. Any order placed, validated by the Customer, and confirmed by the Company, under the conditions and according to the methods described above, on the website constitutes the formation of a contract concluded remotely between the Customer and the Company.
Article 5: Prices
The Products are supplied at the current prices listed on the site, at the time of the registration of the order by the Company. Prices are expressed in Euros, exclusive, and inclusive of VAT. The prices take into account any discounts that may be granted by the Company on the website. These prices are firm and non-revisable during their validity period, but the Company reserves the right, outside the validity period, to modify the prices at any time. The prices do not include the costs of processing, shipping, transport, and delivery, which are invoiced in addition, under the conditions indicated on the site and calculated before placing the order.
Article 6: Terms of Payment
The price is paid by secure payment, according to the following methods:
- Payment by stripe
- Payment by paypal
- Payment by Apple pay
- Payment by Google pay
The price is payable in full by the Customer on the day the order is placed. Payment data is exchanged in encrypted mode using the protocol defined by the approved payment service provider involved in banking transactions carried out on the website.
Article 7: Deliveries
Products ordered on our site are shipped within mainland France and internationally. Delivery times may vary depending on the destination.
Order Shipment:
Due to a shortage of staff, orders placed from Monday to Friday will be shipped Saturday. This means that products will typically be delivered during the following week. Customers will be notified by email when their order has been dispatched, including a tracking number to monitor the shipment.
Shipping Fees:
Shipping fees are calculated based on the destination and the weight of the package. These fees are indicated at the time of order confirmation.
Delivery Times:
Once shipped, products are typically delivered within 3 to 5 business days in mainland France. For international deliveries, the timeframe may vary between 7 and 14 business days depending on the destination.
Delays and Delivery Issues:
In the event of a delivery delay, we invite you to contact our customer service team for updates on the status of your order. In case of loss or damage to the package, please contact us as soon as possible so that we can take the necessary measures.
Delivery is constituted by the transfer to the Customer of physical possession or control of the Product. Except in special cases or unavailability of one or more Products,
Article 8: Pre-Orders
For pre-ordered Products, a notification email will be sent as soon as the Product becomes available and it will be shipped accordingly. The processing time for pre-orders varies from 4 to 8 weeks.
Article 9: Transfer of Ownership – Transfer of Risks
The transfer of ownership of the Products to the Customer will only be made after full payment of the price by the latter, regardless of the delivery date of said Products. Whatever the date of the transfer of ownership of the Products, the transfer of the risks of loss and deterioration relating thereto will only be realized when the Customer physically takes possession of the Products. The Products therefore travel at the risk of the Company.
Article 10: Right of Withdrawal
According to the legal provisions in force, the Customer has a period of 14 days from receipt of the Product to exercise his right of withdrawal from the Company, without having to justify reasons or pay a penalty, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within 14 days (for example, without any use, wear, or damage). Returns must be made in their original state and complete (packaging, accessories, instructions, etc.) allowing them to be remarketed as new, accompanied by the purchase invoice. Damaged, soiled, or incomplete Products are not taken back. The right of withdrawal can be exercised online, using the withdrawal form available on the website. In this case, an acknowledgment of receipt on a durable medium will be immediately communicated to the Customer by the Company. In case of exercise of the right of withdrawal within the aforementioned period, only the price of the Product(s) purchased and the shipping costs are reimbursed; Return shipping costs are your responsibility, except in cases of defective products or errors on our part. The exchange (subject to availability) or refund will be made within 30 days from the receipt by the Company of the Products returned by the Customer under the conditions provided for above.

Article 12: Liability
The Products sold on the website comply with the regulations in force in France and have performances compatible with non-professional uses. The Products supplied by the Company benefit by right and without additional payment, independently of the right of withdrawal, in accordance with the legal provisions:
- the legal guarantee of conformity, for Products that appear defective, spoiled, or damaged or do not correspond to the order,
- the legal guarantee against hidden defects resulting from a material, design, or manufacturing defect affecting the delivered products and making them unfit for use,
Provisions relating to legal guarantees are reproduced in the appendix to these GTCS. Any guarantee is excluded in case of misuse, negligence, or lack of maintenance by the Customer, as in the case of normal wear of the Product, accident, or force majeure. The Company’s guarantee is limited to the replacement or reimbursement of non-compliant or defective Products. To assert his/her rights, the Customer must inform the Company, in writing, of the non-conformity of the Products within a maximum period of 2 years from the delivery of the Products or the existence of hidden defects within the deadlines above and return the defective Products in the state in which they were received with all the elements (accessories, packaging, instructions, etc.). The Company will reimburse, replace or have repaired the Products or parts under warranty deemed non-compliant or defective. Shipping costs will be reimbursed based on the invoiced rate and return costs will be reimbursed upon presentation of receipts. Refunds for Products deemed non-compliant or defective will be made as soon as possible and at the latest within 30 days following the Company’s finding of the lack of conformity or hidden defect. The refund will be made by crediting the Customer’s bank account or by bank check sent to the Customer. The Company’s liability cannot be engaged in the following cases:
- non-compliance with the legislation of the country in which the products are delivered, which it is up to the Customer to verify,
- in case of misuse, use for professional purposes, negligence, or lack of maintenance by the Customer, as well as in case of normal wear of the Product, accident, or force majeure.
Article 13: Data Protection
In application of the law 78-17 of January 6, 1978, it is reminded that the personal data requested from the Customer are necessary for the processing of his/her order and the establishment of invoices, in particular. This data may be communicated to any partners of the Company responsible for the execution, processing, management, and payment of orders. The processing of information communicated through the website has been declared to the CNIL. The Customer has, in accordance with national and European regulations in force, a permanent right of access, modification, rectification, and opposition regarding the information concerning him/her. This right can be exercised under the conditions and according to the methods defined on the site.
Article 14: Intellectual Property
The content of the website is the property of the Company and its partners and is protected by French and international laws relating to intellectual property. Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an offense of counterfeiting.
Article 15: Applicable Law – Language
These GTCS and the operations resulting from them are governed and subject to French law. These GTCS are written in French. If they are translated into one or more foreign languages, only the French text will prevail in the event of a dispute.
Article 16: Disputes
All disputes to which the purchase and sale transactions concluded in application of these GTCS could give rise, concerning their validity, interpretation, execution, termination, consequences, and consequences, and which could not be resolved between the seller and the Customer, will be submitted to the competent courts under the conditions of common law.
Article 17: Acceptance of the GTCS
The fact that a natural (or legal) person orders on the Company’s website entails full and complete adherence and acceptance of these GTCS and obligation to pay for the Products ordered, which is expressly recognized by the Customer, who waives, in particular, to avail himself/herself of any contradictory document, which would be unenforceable against the Company.
